Terms of Service

1. Purpose

These terms govern the use of GetOptiGest services, a suite of business management software offered by GetOptiGest SARL, with share capital of 100,000 MAD, registered with the Casablanca commercial registry.

2. Access to the service

Access to the service requires registration and subscription to a plan. The user agrees to provide accurate information and keep their login credentials confidential.

3. Subscription and payment

Subscriptions are billed monthly or annually depending on the plan chosen.

• Payment is due on the renewal date
• Prices are in MAD excluding taxes
• Applicable VAT is added to the pre-tax amount
• Any started month is due in full

4. Intellectual property

GetOptiGest retains ownership of all intellectual property rights in its software. The subscription grants a non-exclusive, non-transferable right to use for the duration of the subscription.

5. Data

The user remains the owner of their data. GetOptiGest undertakes to ensure confidentiality and security in accordance with our privacy policy. Data is returned upon request at the end of the contract.

6. Service availability

GetOptiGest strives to provide 99.9% service availability. Maintenance interruptions may occur with 48 hours' notice except in emergencies. Compensation may be granted in case of prolonged unavailability under the SLA terms.

7. Liability

GetOptiGest is not liable for indirect damages resulting from service use. Liability is limited to the amount paid over the last 12 months.

8. Termination

The subscription may be terminated at any time with 30 days' notice. In the event of a serious breach, GetOptiGest reserves the right to suspend or terminate access to the service.

9. Governing law

These terms are governed by Moroccan law. Any dispute will be submitted to the competent courts of Casablanca.
