Terms of Service

1. Purpose

These terms govern the use of OptiGest ERP - Gestion Commerciale, software developed and published by ARBARAK TECHNOLOGIES LLC.

2. Licence

The licence grants a perpetual, non-exclusive and non-transferable right to use the version bought, on one PC, for the buyer's own companies. The licence is signed and bound to the machine.

3. Prices and payment

Prices are published in MAD on this website.

• Prices exclude VAT (HT); 20% VAT is added
• The licence is paid once; the support contract and the annual plan are paid every year
• The permanent licence is issued after full payment
• Commercial offers (launch offers, auto-entrepreneur offers, referral) apply under the conditions published on this site on the date of the order; auto-entrepreneur offers cannot be combined with the launch offers

4. Updates and support

Updates and support are included for 12 months, then with the optional support contract. Support covers use of the software, defects and help with restoring; it excludes Windows or hardware repair and accounting advice. Response time: 4 working hours, Monday to Friday 9:00–18:00 (Morocco time).

A customer who stops support keeps using their version. Rejoining support later requires paying the missed years, up to 2 years.

5. Changing PC

Replacing minor components requires no action. When the PC is replaced, 2 transfers a year are free under a support contract; without support, each transfer costs 300 MAD excl. VAT. The old PC's licence is then cancelled.

6. Annual plan and trial licence

When an annual plan or a trial licence ends, data stays readable and exportable; only the creation of new documents is blocked until renewal.

7. Data

The customer owns all of their data. It stays on their PC: ARBARAK TECHNOLOGIES LLC receives none of it. CSV export and a full database backup are possible at any time.

8. Refunds

Since a 7-day trial licence is offered before purchase, no refund is granted after activation, except for a blocking defect not fixed within 15 days.

9. Price changes

Support contract renewals rise by at most 10% a year, with 60 days' notice.

10. Intellectual property

ARBARAK TECHNOLOGIES LLC retains all intellectual property rights in the software. The licence transfers no ownership rights.

11. Liability

ARBARAK TECHNOLOGIES LLC cannot be held liable for indirect damages resulting from the use of the software. Its liability is limited to the amounts paid during the last 12 months.

12. Governing law

These terms are governed by Moroccan law. Any dispute will be submitted to the competent courts of Casablanca.
